Subscriptions

When you subscribe to access the Services, you agree to pay the required subscription fee. If you choose a subscription with an ongoing billing cycle, you agree to pay the subscription fee on each billing date until you cancel your subscription.

To cancel your subscription, please refer to our FAQ page at https://rockclass101.com/faq/ for detailed instructions. If you cancel your subscription, you will retain access to the subscription Services until the end of your current billing cycle, after which your subscription will terminate.

We offer a 30-day money-back guarantee for all first-time subscription purchases. This guarantee is only available to first-time users of the Service. Types of Purchases and Subscriptions

Here is a summary of the different subscription options and purchases available for accessing the Services:

1) Annual Subscriptions

This subscription provides a full year of access to the Services. Payment is required upfront, and your subscription will automatically renew each year on the anniversary of your sign-up unless you cancel. We will notify you by email at the address you provided during sign-up (or any updated email address) 30 days before your renewal date about the upcoming renewal. 2) Monthly Subscriptions

This subscription provides 30 days of access to the Services. Payment is required upfront, and your subscription will automatically renew each month on the same day you signed up unless you cancel. By subscribing, you authorize us to charge the payment method used for your initial purchase for monthly renewals at the same rate as when you signed up. Even if we increase our prices, you will continue to pay the original rate you agreed to.

No refunds are provided for unused portions of a subscription, except within the 30-day Guarantee period.

3) Gift Card Subscriptions Include:

Gift card subscriptions offer various durations and will be subject to the following terms:

A) 3 Month Subscription – This subscription provides access to Rock Class 101 for ninety (90) days and will automatically end at the end of this period.

B) 6 Month Subscription – This subscription provides access to Rock Class 101 for one hundred and eighty (180) days and will automatically end at the end of this period.

No refunds are provided for any unused portion of a Gift Card subscription, and the 30-day Guarantee does not apply to Gift Card subscriptions. Gift cards and promotional codes can only be used once and cannot be exchanged for cash.

License to Use the Services

Upon signing up and completing registration, and subject to your compliance with these Terms, you are granted a non-exclusive, non-transferable, revocable license to access and use the Rock Class 101 Services solely for your personal, non-commercial use.

When using the Services, you agree not to:

1) Sell, rent, or sublicense any material from the Services.
2) Re-publish material from the Services, including on other websites.
3) Redistribute material from the Services, unless it is specifically made available for redistribution.
4) Reproduce, duplicate, copy, or exploit any material from the Services for commercial purposes.
5) Modify or edit any material on the Rock Class 101 website or other platforms.
6) Publicly display any material from the Services.

User Contributions and Forums

When you post materials, messages, comments, opinions, or other content to the Services (e.g., through forums) (collectively, “User Contributions”), you agree that your contributions will:

1) Not be libelous, defamatory, obscene, pornographic, fraudulent, harmful, threatening, abusive, hateful, or otherwise offensive or illegal.
2) Not infringe on any copyrights, trademarks, patents, trade secrets, or other intellectual property rights.
3) Not violate the privacy or publicity rights of others.
4) Be free from viruses, adware, spyware, worms, or other malicious code.

The views expressed in User Contributions do not necessarily reflect those of Rock Class 101 or its content providers. Rock Class 101 does not review or monitor User Contributions and assumes no responsibility for their content. However, we reserve the right to monitor, review, and disclose User Contributions to:

1) Comply with legal or regulatory requests.
2) Ensure proper operation of the Services.
3) Protect ourselves and other users, in accordance with our Privacy Policy.

Rock Class 101 may refuse to post, edit, or remove any User Contributions that we deem unacceptable or in violation of these Terms. We are not responsible for any loss of User Contributions or data due to system errors, editing, or other issues.

By submitting User Contributions, you grant Rock Class 101 a royalty-free, perpetual, irrevocable, non-exclusive worldwide license to use, reproduce, adapt, modify, create derivative works from, sublicense, transmit, distribute, publish, publicly perform, display, or otherwise exploit any part of your contributions in any manner and through any technology now known or developed in the future. You also waive any moral rights related to your User Contributions.

Intellectual Property

The Services, including their features and functionality, are the exclusive property of Rock Class 101 and its licensors. They are protected by copyright, trademark, and other intellectual property laws in the United States and other countries. You may not use our trademarks or trade dress without Rock Class 101’s prior written permission.

Medical Clearances and Injuries

You are responsible for determining whether you are physically capable of playing the ukulele (or any instrument in which we create lessons for) and for obtaining any necessary medical advice or clearances based on your personal health and abilities before participating in any tutorials or lessons provided by Rock Class 101.

By engaging in any tutorials or lessons, you acknowledge and accept the inherent risks associated with such activities that a reasonable person would be aware of.

To the fullest extent allowed by law, you agree to:

1) Release and discharge Rock Class 101 and its officers, contractors, and staff from any liability for property damage or personal injury that arises from or is related to your participation in our lessons or tutorials.
2) Assume full responsibility for any harm that may occur as a result of obvious risks associated with participating in our lessons or tutorials.
3) Hold harmless and indemnify Rock Class 101 and its officers, contractors, and staff from any claims, losses, or liabilities for property damage or personal injury related to your participation in our lessons or tutorials.

IF APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF SOME OR ALL OF THE ABOVE IMPLIED WARRANTIES TO APPLY TO YOU, THE ABOVE EXCLUSIONS WILL APPLY TO YOU ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia and the laws of the United States of America applicable therein.

No Waiver

Rock Class 101’s failure to enforce any provision of these terms or the privacy policy, or failure to exercise any right under them, shall not be construed as a waiver or relinquishment of Rock Class 101’s right to assert or rely upon such provision or right in that or any other instance.

Integration and Severability

If any provision of these terms is deemed unlawful, void, invalid, or unenforceable by a court or other competent authority, that provision shall be severable from these terms and shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect. These terms represent the entire agreement between you and Rock Class 101 regarding the Service and supersede any prior agreements between us concerning the Service.
